Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Floks website, booking platform, and mobile applications (collectively, the "Platform"), operated by Floks, UAB, a private limited liability company registered in Lithuania under company code 307946604, with its registered office at Giedraičių g. 39, R53, LT-09302 Vilnius, Lithuania ("Floks", "we", "us", or "our").
By creating an account, making a booking, or listing as a CFI, aircraft owner, or flight operator, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. About Floks and the Platform
Marketplace intermediary. Floks provides an online platform that connects pilots and aviation enthusiasts ("Guests") with certified flight instructors, aircraft owners, and flight operators ("Operators"). Floks is a marketplace intermediary and technology provider only.
What Floks is not. Floks does not own, operate, maintain, charter, insure, or provide flight instruction for any aircraft or lesson listed on the Platform. Floks is not an air carrier, flight school, aviation training provider, or aviation authority, and does not hold an air operator certificate or equivalent in any jurisdiction. Floks does not act as an agent for any Guest or Operator.
Rental, instruction, and flight agreements are made directly between the Guest and the Operator. Floks is not a party to that agreement.
No verification. Floks does not independently verify the licenses, ratings, medical certificates, insurance, airworthiness, or other credentials or documents that CFIs and Operators self-certify when creating a listing. Listings reflect representations made by the Operator, not confirmations by Floks. Guests are responsible for satisfying themselves that an Operator's credentials and insurance are adequate before booking, including by asking the Operator directly.
2. User accounts
You must register an account to access booking features. You agree to provide accurate, current, and complete information, keep your login credentials confidential, and notify us at hello@flyfloks.com if you suspect unauthorized use of your account. You are responsible for all activity under your account.
3. Operator self-certification
By creating a CFI, aircraft, or flight listing, you (the "Operator") warrant that, throughout any period your listing is active and for the duration of any booking:
- You hold all licenses, ratings, medical certificates, and endorsements required to instruct in or operate the aircraft type listed, under the regulations of the aviation authority with jurisdiction over the flight (for example the FAA in the United States, EASA or a national CAA within the EU, or another applicable regulator).
- Any aircraft you list is registered with the relevant national aviation authority, holds a current airworthiness certificate or equivalent, and is maintained in accordance with an approved maintenance program.
- You hold insurance meeting the requirements described in Section 6 (Insurance) below.
- All information in your listing, including availability, pricing, and aircraft specifications, is accurate and kept up to date.
Floks reserves the right to remove any listing that appears to violate these Terms or applicable law, without independently verifying the underlying facts.
4. Guest responsibilities
You are responsible for ensuring that any flight activity you arrange through Floks complies with the regulations of the aviation authority with jurisdiction over the flight, including airspace, currency, and medical requirements applicable to you personally. Except where a flight instructor or safety pilot on board is acting as Pilot-in-Command in accordance with applicable regulations, you are solely responsible for the safe conduct of any flight in which you act as Pilot-in-Command, including pre-flight planning, weather assessment, and pre-flight inspection of the aircraft. If you identify a defect, damage, or documentation inconsistency during inspection, you must not fly and must report it to the Operator.
In the event of an incident, airspace infringement, or reportable accident, you must notify the relevant aviation safety authority immediately, notify the Operator as soon as practicable, and report the event to Floks at hello@flyfloks.com.
5. Bookings
Arrangements and payments for instruction, aircraft rental, or flights booked through the Platform are made directly between the Guest and the Operator. Floks does not currently process, hold, or facilitate these payments and is not a party to the payment arrangement.
6. Insurance
Operators must, at all times while listed on the Platform and throughout any booking, self-certify that they hold:
- Hull insurance (where they own or are responsible for the aircraft) covering third-party rental or instructional use as applicable.
- Third-party liability insurance adequate for the aircraft type and activity.
- Passenger liability insurance where passengers are carried.
- Where the Operator is not the sole intended pilot, cover extending to renting or student pilots (commonly called "self-fly hire" cover in some markets).
Floks does not verify this insurance and does not itself provide, arrange, or guarantee any insurance coverage. Floks is not an insurer. Guests who want to confirm coverage before a flight should ask the Operator directly for evidence of current insurance — this is a normal and reasonable request. Guests may also wish to hold their own renter's or non-owned aircraft insurance for additional protection; this is optional and not provided by Floks.
7. Prohibited activities
You agree not to use the Platform, or any aircraft or instruction booked through it, to:
- Conduct illegal commercial flights, public transport operations, or air taxi services for compensation in violation of applicable aviation law.
- Carry out aerobatic maneuvers, formation flights, or flight testing unless explicitly authorized by the Operator and covered by applicable insurance.
- Operate in prohibited or restricted airspace, or land at locations not approved by the Operator.
- Sub-lease, lend, or transfer operational control of an aircraft to anyone not authorized by the Operator.
- Provide false or misleading information about your identity, licensing, ratings, currency, or insurance.
- Use the Platform for any unlawful purpose.
8. Disputes between Guests and Operators
Floks is not a party to any rental, instruction, or flight agreement between a Guest and an Operator. Disputes about aircraft condition, instruction quality, flight conduct, damage, delays, weather cancellations, or payment are matters between the Guest and the Operator. Floks may, at its discretion, help resolve such disputes but is under no obligation to do so and does not guarantee any outcome.
9. Limitation of liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, fraud, or willful misconduct, or any liability that cannot be excluded under mandatory Lithuanian or EU consumer-protection law.
Subject to the paragraph above, to the maximum extent permitted by applicable law, Floks shall not be liable for any direct, indirect, incidental, or consequential loss arising from your use of the Platform, including the airworthiness or condition of any aircraft listed, personal injury or death arising during a flight, cancellations or no-shows, or the accuracy of any credential or document self-certified by an Operator.
10. Indemnification
You agree to indemnify, defend, and hold harmless Floks, Floks UAB, and our directors, officers, employees, and agents from any claims, losses, liabilities, costs, and legal expenses arising from or relating to: the operation of any aircraft or conduct of any instruction booked or listed via the Platform; your breach of these Terms; your breach of applicable aviation law or regulation; your negligent, reckless, or unlawful acts or omissions; or any third-party claim arising from your use of the Platform.
11. Termination
Floks may suspend, restrict, or terminate any account, at its discretion and without prior notice, where we reasonably suspect a material violation of aviation safety regulation, provision of fraudulent or materially misleading credentials or insurance information, material breach of these Terms, or conduct that risks the safety of people or property. Where termination is not for cause, we will give reasonable notice where practical.
12. Platform availability
Floks does not guarantee the Platform will be available at all times, error-free, or uninterrupted, and may suspend access for maintenance or other reasons with or without notice.
13. Force majeure
Floks is not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including adverse weather, regulatory action, strikes, cyberattacks, or failures of third-party infrastructure we rely on.
14. Changes to these Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Lithuania. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Lithuania, except that Floks may seek injunctive relief in any jurisdiction to protect its rights. This clause governs disputes about the Floks-user contract only — it does not affect which aviation authority has regulatory jurisdiction over any specific flight, which is determined by aircraft registration and airspace, not by this clause.
16. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision is severable and does not affect the remaining provisions.
17. Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Floks regarding your use of the Platform.
